Tankyu Distillery Festival 2026 — Terms of Participation

This is a reference translation provided for convenience. The Japanese version is the authoritative text and governs in the event of any discrepancy (Article 19).

Introduction

These Terms set out the conditions of participation in the "2026 TANKYU DISTILLERY FESTIVAL with Michizakura Sake Brewery (Tankyu Distillery Festival)" (hereinafter "the Event"), organised by Tankyu Distillery K.K. (hereinafter "the Company") and held with the cooperation of Michizakura Sake Brewery. Any person who attends or takes part in the Event (hereinafter "Participant") shall be deemed to have agreed to these Terms. Dates: Saturday 1 August – Sunday 2 August 2026, 10:00–17:00 Venue: Tankyu Distillery / Michizakura Sake Brewery (Nishi 2-go Kita 23, Higashikawa-cho, Kamikawa-gun, Hokkaido) Admission: Free

Article 1 (Application and Consent)

These Terms apply between the Company and Participants in relation to the Event. By entering the venue or applying for any programme, a Participant is deemed to have agreed to all of the contents of these Terms. Persons who do not agree to these Terms may not participate in the Event.

Article 2 (Consumption of Alcohol)

1. The consumption of alcohol by persons under 20 years of age is prohibited by law. Age verification may be carried out when alcoholic beverages are served, and service will be refused where a person does not comply with a request to present official documentation confirming their age. 2. Persons arriving by car, bicycle or similar means, persons who are pregnant or breastfeeding, and persons who are unwell should refrain from consuming alcohol. Drink-driving is strictly prohibited by law. 3. The Company may refuse to serve alcoholic beverages to, or request the departure of, any person who is intoxicated or whom the Company otherwise considers unsuitable. 4. Please refrain from taking alcoholic beverages out of the venue, and from bringing food or drink into the venue.

Article 3 (Paid Experiences and Merchandise Sales)

1. The craft gin free-flow (60 minutes, ¥1,000), the whisky cask-filling experience "Your Cask" (君の樽) (¥11,000; ¥10,000 for HUC members) and other paid programmes involving alcoholic beverages are all limited to persons aged 20 or over, and identity verification may be carried out at the time of application. 2. For paid programmes provided and consumed on the same day, cancellations and refunds cannot be accepted after an application has been made. 3. Where an application is made online, a separate notice based on the Act on Specified Commercial Transactions shall be established and shall apply. 4. Dispatch of prizes and products is limited to destinations within Japan. We do not ship overseas; persons residing outside Japan are therefore asked to collect their items at the distillery.

Article 4 (The Community Cask "Your Cask")

This Article applies to the whisky cask-filling experience "Your Cask" (君の樽) (hereinafter "the Programme"), and where this Article provides otherwise than the preceding Article in relation to the Programme, this Article shall prevail. 1. Nature of the Programme — The Programme is an experience in which Participants fill a communal cask managed by the Company with whisky (new-make spirit), and the whisky matured in that cask is subsequently bottled and delivered to Participants. 2. Ownership and management — The cask and its contents shall be possessed and managed by the Company at the Company's distillery under its liquor manufacturing licence and related authorisations until the time of bottling and delivery. Participants do not acquire ownership of the cask itself by virtue of the Programme, and may not request the withdrawal, removal or tasting of the contents during the maturation period. 3. Maturation and quantity — Whisky is a natural product, and a loss of volume through evaporation and similar causes (the angel's share) occurs during the maturation process. Accordingly, the final number of bottles, volume, alcoholic strength, colour, aroma, flavour and similar characteristics delivered are subject to variation, and the Company does not guarantee them. 4. Quality and risk — As a result of maturation, the whisky may fail to attain the aroma, flavour or quality initially anticipated, or all or part of the contents may be lost due to a defect in the cask, leakage, disaster or similar causes. Except in cases of wilful misconduct or gross negligence on the part of the Company, the Company shall bear no liability for these matters, and shall respond, as necessary, by delivering an equivalent substitute or by taking other reasonable measures. 5. Delivery — Delivery is scheduled for around 2029, but may be brought forward or delayed due to the state of maturation, laws and regulations, production circumstances or other causes. Delivery shall be either by shipping within Japan or by handover at the distillery. We do not ship overseas. Receipt requires that the recipient be 20 years of age or over at the time of delivery and that valid contact details be provided. 6. Receipt and storage — Participants shall take receipt within the period specified by the Company following notification from the Company. Should contact details change, please notify us promptly. Where handover cannot be effected for a considerable period because contact details are unknown or for other reasons attributable to the Participant, the Company shall be released from its obligations under the Programme, and shall not refund the consideration or provide any other compensation. 7. Laws, regulations and liquor tax — Bottling and handover under the Programme are premised on the Company holding the licences necessary for the manufacture and sale of alcoholic beverages and on their being carried out in compliance with the relevant laws and regulations. Where handover as whisky becomes difficult for reasons of law or regulation, the Company shall, following consultation with the Participant, determine substitute measures or the treatment of the consideration. 8. Cancellation, transfer and inheritance — Where cancellation is desired after an application has been made, we will consider the matter individually by the method prescribed by the Company. Rights under the Programme may not be transferred or resold to a third party without the prior consent of the Company. The treatment of cases in which a Participant's rights pass by inheritance shall be determined by the method prescribed by the Company, through consultation between the Company and the heirs. 9. No investment purpose — The Programme is an experience programme intended to enable participation in craftsmanship, and is not intended for investment, asset management or financial gain. The Company gives no guarantee whatsoever as to the maintenance or increase of the asset value of the contents or the finished product. 10. Use — The whisky delivered is intended for consumption by the Participant personally. Where a Participant uses it for resale or other commercial purposes, the obtaining of any necessary permits and approvals and other compliance with laws and regulations shall be carried out at the Participant's own responsibility.

Article 5 (Photo Contest)

1. Method and period of entry — Entries to the photo contest are made by posting a photograph relating to the Event to social media with the designated hashtag "#丹丘感謝祭". When entering, please set your account to public so that the Company can view the posted content. The entry period and other details will be announced separately on the Event's official website or on the Company's official social media accounts. 2. Eligibility — Anyone may enter. However, minors entering must do so with the consent of a person with parental authority or similar. A single person may not enter using multiple accounts. 3. Requirements for works — Posted works are limited to original works photographed or created by the entrant themselves. Works that infringe the copyright, portrait rights, privacy or other rights of third parties, works contrary to public order and morals, works that violate laws or regulations, and works markedly contrary to the spirit of the Event may not be entered. 4. Attribution of rights and licence — By entering, the entrant is deemed to have agreed that the Company may use the posted work for public relations, advertising, product labels (including adoption on the cask label for the Grand Prize work) and other purposes, with such modification, cropping and processing as may be necessary, free of charge and without restriction as to territory, period or medium. The entrant shall not exercise moral rights of the author in respect of the posted work against the Company or persons designated by the Company. 5. Representations and warranties — The entrant warrants that they lawfully hold the necessary copyright, portrait rights and other rights in the posted work themselves, or that they have obtained the necessary permission from the rights holders (including persons appearing in the work). Where a dispute arises with a third party in relation to a work, the entrant shall resolve it at their own responsibility and expense, and the Company shall bear no liability whatsoever. 6. Selection and announcement — Winning works will be selected by the Company according to its own criteria. We are unable to respond to enquiries regarding the course or reasons of the selection. Results will be announced through the Event's official website or the Company's official social media accounts and similar channels, and winners will be contacted by the method prescribed by the Company (such as a direct message on social media). Where a winner cannot be contacted within the period specified by the Company, or does not comply with the guidance necessary for receipt of the prize, the award may be invalidated. 7. Prizes — The contents of the prizes shall be as set out in the announcements for the Event. Prizes cannot be exchanged for cash or changed for other goods. Alcoholic beverages among the prizes may be received only by persons aged 20 or over. Where a winner is under 20 years of age, the prize will be changed to a substitute prize prescribed by the Company, or will be received by a person with parental authority or similar. Dispatch of prizes shall be either by shipping within Japan or by handover at the distillery. We do not ship overseas. The provisions of Article 4 shall apply mutatis mutandis to the treatment of the "Your Cask" whisky awarded as the Grand Prize. 8. Disqualification and revocation of awards — Where there is entry by improper means, entry from multiple accounts, the acquisition of "likes" or similar in exchange for consideration, a breach of these Terms or any other conduct that the Company considers inappropriate, the Company may, without prior notice, invalidate the entry concerned or revoke the award. The same shall apply where a fact constituting a breach of this Article comes to light after an award has been made. 9. Relationship with social media platforms — This contest is not provided, sponsored or operated by any social media platform. Entrants shall comply with the terms of each platform they use, and the Company shall bear no liability for damage arising from changes to platform specifications, faults, deletion of posts or similar causes. 10. Disclaimer and changes — The Company shall bear no liability where an entry is not accepted for reasons of communications or systems, or for any other non-arrival or delay of entries. The Company may change or cancel this contest where unavoidable circumstances so require.

Article 6 (Photography and Filming)

Within the venue, the Company or persons commissioned by the Company may take photographs and film footage and use them for public relations, advertising and similar purposes. Participants agree in advance that the Company may use photographs and footage in which they appear as a subject for these purposes. If you do not wish to appear, please inform a member of staff nearby.

Article 7 (Handling of Personal Information)

Personal information obtained by the Company in relation to the Event will be used only for the purposes of operating the Event, dispatching prizes and products, and contacting customers, and will not be provided to third parties without the consent of the individual concerned, except where based on laws and regulations.

Article 8 (Refusal of Admission and Participation)

Where the Company determines that any of the following items applies, it may, without prior notice, refuse admission or participation, or request departure from the venue. In such cases, the Company shall bear no liability for any damage incurred by the Participant concerned. (1) Where the Participant does not comply with these Terms or the instructions of staff (2) Where the Participant causes nuisance or hindrance to other Participants, vendors, the neighbourhood, or the operation of the Event (3) Where the Company determines that it is necessary to ensure safety or for other operational reasons

Article 9 (Admission Restrictions, Capacity and Transport)

1. In order to ensure safety within the venue, the Company may manage the number of persons within the venue and, depending on the state of congestion, take measures including the temporary restriction of admission, marshalling, asking visitors to wait (including the distribution of numbered tickets), restrictions on re-entry and other necessary measures. 2. The distillery tour, the craft gin free-flow, the whisky cask-filling experience "Your Cask", other programmes, and the shuttle bus each have a capacity. Where capacity is reached, applications may be closed on a first-come, first-served basis, by advance reservation or by such other method as the Company may determine, and the Company does not guarantee that all persons will be able to participate or board. 3. The Company may change the capacity, number of sessions, operating times and time slots of the programmes and the shuttle bus where necessary for reasons of safety or operation. 4. The operating times of the free shuttle bus may be changed or delayed due to traffic conditions or similar causes. Boarding is at each person's own responsibility.

Article 10 (Prohibited Conduct)

The following conduct is prohibited at the Event: bringing in dangerous articles or naked flames; conduct that obstructs other customers or the operation of the Event; unauthorised photography, filming, news gathering, sales or solicitation for commercial purposes; damage to facilities or equipment; and any other conduct contrary to laws and regulations or to public order and morals.

Article 11 (Safety within the Facility and Disclaimer)

1. The Event venue is a manufacturing facility containing operating distillation equipment. Within the venue there may be machinery and equipment, heated apparatus, casks, pipework, steps, sloping walkways, vehicle movements and other hazards. Participants shall act at their own responsibility with an awareness of these hazards, remain within the areas designated by the Company, and follow the instructions of staff and the notices and signage within the venue. 2. Participants shall not enter areas that are off limits or in which entry is restricted to authorised persons, and shall not touch or operate manufacturing equipment, machinery, casks, exhibits or other equipment and fixtures without permission. 3. Within the venue, please refrain from running and other dangerous conduct, and from conduct that impairs the safety of other Participants. Persons accompanied by small children are asked to remain with them at all times and not to take their eyes off them, at the responsibility of the guardian. In an emergency, please follow the instructions of the Company and its staff regarding rescue, evacuation and similar matters. 4. Food and drink may contain allergens. Please decide for yourself whether to consume them. 5. Liability for damage arising from food, drink, goods or services provided by vendors such as food trucks, by Michizakura Sake Brewery, or by other third parties shall be borne by the provider concerned. 6. Where a Participant suffers damage as a result of the Participant's breach of these Terms or of the instructions of staff, of causes attributable to the Participant themselves, or of causes arising between Participants or with third parties, the Company shall bear no liability. 7. Except in cases of wilful misconduct or gross negligence on the part of the Company, the Company shall bear no liability for accidents, injury, illness, theft, loss or other damage occurring within the venue.

Article 12 (Cancellation and Alteration of the Event)

The Company may cancel, suspend or alter all or part of the Event due to weather, disaster, the outbreak of infectious disease or other unavoidable circumstances. In such cases, the Company shall not compensate for travel costs, accommodation costs or any other expenses whatsoever, save for the refund of consideration already paid for paid programmes.

Article 13 (Force Majeure)

1. Where delay, alteration, cancellation or impossibility arises in the operation of the Event, the conduct of paid programmes, or the delivery of "Your Cask" or other products due to acts of God, earthquake, tsunami, typhoon, torrential rain, heavy snow, flood or other natural disaster, fire, power failure, the outbreak or spread of infectious disease or epidemic, war, acts of terrorism, riot, the enactment, amendment or repeal of laws or regulations, orders, dispositions or requests by public authorities, accidents or stoppages affecting transport or communication lines, labour disputes, difficulty in procuring raw materials, equipment or supplies, or other causes beyond the Company's reasonable control (hereinafter "Force Majeure"), the Company shall bear no liability therefor, except in cases of wilful misconduct or gross negligence on the part of the Company. 2. The treatment of cases in which all or part of the Event is cancelled, suspended or altered due to the occurrence of Force Majeure shall be in accordance with the provisions of the preceding Article. 3. Where a state of Force Majeure continues, or is expected to continue, for a considerable period, the Company may, following consultation with Participants, change the contents of paid programmes, effect substitute performance or take other reasonable measures.

Article 14 (Exclusion of Anti-Social Forces)

Participants represent and warrant that they do not fall within the category of organised crime groups or other anti-social forces, and that they have no relationship with such groups. Where the Company determines that this has been breached, the Company may refuse the admission or participation of the Participant concerned.

Article 15 (Prohibition of Assignment of Rights and Obligations)

Participants may not assign to a third party, or offer as security, their status under these Terms or their rights and obligations under these Terms, without the prior written consent of the Company.

Article 16 (Amendment of These Terms)

The Company may amend these Terms without obtaining the individual consent of Participants where it deems it necessary. The amended Terms shall take effect from the time at which the Company posts them on the Event's official website.

Article 17 (Final Determination)

All final determinations regarding the operation of the Event, the treatment of matters not provided for in these Terms, and any doubt arising as to the interpretation of these Terms shall be made by the Company, and Participants shall abide by them.

Article 18 (Severability)

Even where any provision of these Terms, or any part thereof, is held to be invalid or unenforceable in light of laws and regulations, the remaining parts of these Terms other than that part shall continue in full force and effect.

Article 19 (Governing Law, Language and Jurisdiction)

These Terms are governed by the laws of Japan, and the Japanese text shall be the authoritative text. Any dispute arising between the Company and a Participant in relation to the Event shall be subject to the exclusive agreed jurisdiction of the Asahikawa District Court or the Asahikawa Summary Court in the first instance, according to the amount in dispute.
